This agreement constitutes the Terms and Conditions of use as set forth by Chetak Travels Pvt. Ltd. (Chetak Travels, Chetak or The Company) and You (User). The terms, conditions, and notices are subject to amendment time to time and may change without any prior notice. Your use of this Website (www.chetak-travels.com) constitutes your agreement to all such terms/conditions and constitutes your acceptance of any amendments, additions or modifications to this agreement. This Website is for personal and non-commercial use.

The content on www.chetak-travels.com is a combination of proprietary and licensed content. The materials such as photographs, graphics, images, illustrations, advertisements, logos or video clippings are owned by the Company. You will not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works, or sell any information, products or services obtained from this website.Further, you warrant to Chetak Travels that you will not use this Web site for any purpose that is unlawful or prohibited by these terms, conditions and notices.
Modification/Update of the terms of these conditions
The Company regularly updates information provided to You through this website, so that you are kept up to date regarding Chetak’s terms and conditions. However, there is a possibility that the information provided may contain certain typographical and other errors on account of an oversight or lapse on the part of the Company and its employees.The Company encourages you to bring these to our attention and the relevant representative will endeavor to rectify the error or omission at the earliest.The Company reserves the rights to alter or amend the Terms and Conditions without notice. Services Provided
- About: Chetak Travels is a bespoke travel company that helps you plan your trips according to your interests and preferences. In order to get your personalized itinerary and the associated price, the Company requests You to send an email to info@chetak-travels.com with the relevant details of your trip. Generally, one of the travel consultants will get back to you within 5 working days of your request with a quote (“Preliminary Proposal”) that includes the itinerary, the price and the relevant terms and conditions of the offer.The intention of this document/mail is to facilitate the discussion between You and the Company in order to arrive at a final formal proposal (“The Proposal”).

The Proposal / Contract
- The Proposal: After initial exchanges (through email/phone) with Chetak Travels, you will receive The Proposal which summarizes your trip. This document will include all the details regarding your proposed trip (“The Trip”), including terms and conditions relevant to your Trip.
- Validity of The Proposal: The Proposal will generally be valid for 7 working days (Validity Period). Should You require a longer validity period, The Company expects You to let the concerned representative know through an email. If the Company does not hear back from You within the validity period, The Proposal would be deemed void. After the lapse of the validity period and at Your request, Chetak Travels would be happy to provide a revised Proposal.
- Confirmation of the Trip:Once you confirm to undertake the Trip, you are kindly requested to send an email to the concerned representative at Chetak Travels. This email will assume your acceptance to the terms and conditions in the Proposal. The contract shall come into effect (“Tour Contract”) on the date of your email.
- Group Travel:If you are travelling in a group, the tour organizer“Group Leader” may confirm a booking on behalf of all the travelers listed in the Tour Contract. In such cases, the Group Leader takes contractual responsibility for all the travelers and it is the Group Leader’s responsibility to ensure that all the other travelers abide by the terms and conditions specified in the Tour Contract

Contractual Price and Payment Terms
- Invoice: Once the Tour Contract has been agreed by both parties, Chetak Travels will send you an invoice for the trip which will include, among others, the final contractual price including all applicable taxes, a summarized itinerary andthe relevant bank account details
- Advance Payment: Based on the timing of the booking (i.e. number of days in advance of the travel), Chetak Travels will require you to make an advance payment for the Tour Package. As a general rule, Chetak Travels would require 30% of the total contractual price as an advance. Considering that various suppliers such as airlines, hotels and on-ground transportation providers have differing policies on advance bookings, Chetak Travels will intimate you in writing with regards to the payment terms specific to your contract. This will take into account the various terms provided by the suppliers involved in your proposed trip.
- Balance Payment: Chetak Travels would require you to pay the Remaining Amount of the Contractual Price (Remaining Amount = Contractual Price – Advance Paid), 6 weeks before the start date of your trip.If the booking is made and confirmed within thirty (30) days of the proposed date of travel, Chetak Travels would require 100% of the Contractual Price (on receipt of the invoice) to be paid upfront
- Release of Travel Documents: Once the full payment has been received, Chetak Travels shall release the relevant flight tickets, hotel vouchers and any other specific documentation with regards to your trip

Documentation provided by You for the Tour Contract
- Legal Age: You must be an adult and of legal age to enter into a binding agreement with the Company
- Accuracy of Details provided by You: Under these conditions,You are required to provide The Company or the concerned representative only accurate and valid information while requesting services from Chetak.
- Passport: You are required to hold a passport which is valid for a minimum period of six (6) months from the date of return of your trip
- Visa: It is your responsibility to adhere to the relevant procedures to obtain a Visa for the country you propose to visit. In certain cases, Chetak Travels will facilitate the relevant documentation in order that you obtain your visa. However, the Company bears no liability whatsoever in case of non-issuance of the relevant Visa. The Company would like to inform You that only the relevant Embassies, Consulates, High Commissions or the sovereign governments of countries have the sanctioning power to issue and grant visas, immigration clearances and other official permits

Cancellation Terms
- Notification: If You would like to cancel your Tour Contract any time before the start date of your trip, You are requested to send an email to the concerned representative at Chetak Travels
- Effective date: The date of cancellation is the date on which the Company receives your email (India time)
- Refund policy: The Company generally follows the below terms:
- For cancellations made 90 or more days prior to the start date of the trip 20% of the contractual value of the trip will be charged
- For cancellations made 89-20 days prior to the start date of the trip 50% of the contractual value of the trip will be charged
- For cancellations made 19-8 days prior to the start date of the trip 80% of the value of the trip will be charged
- For cancellations made 7 days or less prior to the start date of the tour 100% of the value of the trip will be charged
- After start of your trip, any shortening / unused portion of trip will not be refunded
- All international/domestic flights booked through Chetak Travels, will attract the cancellation /refunds rules specific to your airlines and may differ from the above.

Cancellation due to a “Force Majeure Event” (Circumstances Beyond Control of The Company)
- Force Majeure Event: An event that is an act of God that is related to weather conditions, floods, fire, accident,breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, epidemics or any other causes beyond The Company’s control (“Force Majeure Event”).
- The Company shall not be responsible to You for any loss, injury or damage to person, property, changes in tour itinerary, or otherwise in connection with any accommodation, transportation or other services, resulting – directly or indirectly – from any Force Majeure Event
- In the event of a Force Majeure Event, either You or the Company may choose to terminate the Tour Contract. On termination of the Tour Contract as specified in this clause, The Company, where possible, will make a commercially reasonable effort to refund the relevant amount paid by You, less the amount already spent on You by the Company during the tour and any other non-refundable fees and charges.
- Please note that the Company shall not be obligated to and does not guarantee that You shall receive a refund.
- The Company’s intention is to work in the best interests of both parties to arrive at a fair solution

Changes in Tour Contract requested by You
- If You would like to change any part of The Proposal after having accepted the terms and conditions, the concerned representative will be happy to discuss with you a Revised Contractbased on your preferences/changes.
- In the event that the Revised Contract requires additional payments, The Company will send you a Revised Invoice with the relevant payment terms.
- On acceptance, the terms and conditions of the Revised Contract will apply thereafter.

Changes in Tour Contractby Chetak
- The Company reserves the right to modify or deviate from the Tour Contract in special circumstances, before the commencement of your trip
- These changes may be carried out by Chetak because of certain special/unforseen circumstances such as cessation of business by a third party provider, death or insolvency.
- The concerned representative will make a reasonable effort to notify you in advance of any such changes, keeping in mind Your interests and preferences.

Refund Policy
- The Company shall aim to refund any applicable amount within forty five (45) days of the receipt of the request/instruction to cancel or change the tour.
- The refund period may also be subject to change based on any Government regulations regarding the outflow of foreign currency outside of India.

Third Party Providers and Liability of The Company
- Chetak may work with third party providers in order to carry out Your specified Tour Contract
- It is Your duty to cooperate at all times with the personnel of any such providers (local tour operators, airlines, hotel staff, instructors, tour guides, etc)
- The Company takes responsibility for any omissions or changes associated with third party providers engaged by The Company.
- However, the company does not take any responsibility if You sustain any loss of life/limb, property, money, sickness, etc on account of a third party not engaged by Chetak. In addition, The Company takes no responsibility for any untoward act of any of your co-travelers
- The Company also doesn’t take any responsibility for any transactions entered by You as an individual during the Tour Contract

Travel Insurance
- The insurance provided by Chetak, airlines, hotels, or third party providers is limited per se. In addition, each country has specific rules and regulations with regards to travel related contracts. The Company advises you to obtain sufficient insurance coverage from specialized Insurance providers for your trip in order to ensure that You are reasonably covered under any circumstance.

Applicable Law and Jurisdiction
- In case of any dispute, the Company and its representatives will aim to resolve through good faith and a direct discussion between parties. In case of non-resolution of the matter, the laws of India will be the applicable law for the resolution of the dispute.
